Digitalinet user agreement: Content - Digitalinet reserves the right to refuse service to anyone. Customers may only use Digitalinet's servers for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. The designation of any materials as such described above is left entirely to the discretion of Digitalinet management. Regardless of the place of signing this agreement, the client agrees that for purposes of venue this contract was entered into in Pinellas County, Florida, and any dispute will be litigated or arbitrated in Pinellas County, Florida. Unacceptable Use – You may not use your telnet access for anything else but to manage your account & webpage. This includes irc related items. Digitalinet reserves the right to disable any script/content/services that effects normal server operation without prior warning. Liability/Agreement - Customer agrees that it shall defend, indemnify, save and hold Digitalinet harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Digitalinet, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold Digitalinet harmless against any liabilities. Digitalinet will not be responsible for any damages you or your business may suffer. Digitalinet makes no warranties of any kind, expressed or implied for services we provide. Digitalinet disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Digitalinet and its employees. Digitalinet reserves the right to revise its policies, pricing & services at any time. Digitalinet also reserves the right to cancel your account for abuse or for any reason it chooses to at any time. Refunds - Digitalinet does not offer refunds in any way. Digitalinet is not liable for any overdraft or over-limit fees that may occur per your banks policies. Free Domains - If a domain is given to a customer by Digitalinet via one of the "Free Domain" plans then there is a 180 day minimum commitment, until that 180 day commitment is met digitalinet is the sole owner of the domain. If a domain has been registered for free by Digitalinet for a client, the client is responsible for domain name renewal fees after the first year of service. Spam - Unsolicited commercial advertisements are not allowed in e-mail, and will likely result in account suspension or cancellation. Commercial email advertisements are unwelcome. E-mail is a person-to-person medium, not a broadcast medium. Upon your first Spam offense your mail will be disabled for 48 hours. Upon your second Spam offense your account with Digitalinet will be terminated, you will be fined $100.00 per sent spam. Domain name agreements. |
